  • Carrying weapons in a prohibited place – Intentionally, knowingly, or recklessly possessing a firearm on the grounds of an educational institution or in a passenger vehicle operated by an educational institution, at a polling place, on court premises, at racetracks, in secured areas of airports, on the premises of businesses licensed to sell alcohol, at a sporting event, at a correctional or civil commitment facility, at a hospital or nursing facility, in amusement parks, or at open government meetings.
  • Unlawful carrying of a handgun by a license holder – Intentionally displaying a handgun in plain view of another person in a public place (except that handguns may be carried in holsters).
  • Unlawful possession of a firearm – Possession of a firearm by a person convicted of a felony, within five years of release from confinement or supervision, a person in a criminal street gang, or a person convicted of a Class A misdemeanor domestic violence offense.
  • Possession of prohibited weapons – Prohibited firearms under Texas law include machine guns and short-barrel firearms.
  • Unlawful transfer of weapons – Transferring a handgun to a person known to intend to use the firearm in a crime, or intentionally or knowingly transferring a firearm to a minor, an intoxicated person, an ineligible felon, or a person subject to an active protective order.

Should I answer the police’s questions?

You should never agree to speak to the police until you have had the chance to consult with a criminal defense attorney. You have the right to speak with a lawyer prior to questioning and to have your attorney present during questioning. Criminal investigators are trained in interrogating suspects and asking questions in a manner designed to get suspects to make incriminating statements. An attorney can review the circumstances of your case and advise you whether you can help your case by answering questions from the police. However, in most cases, you will only end up hurting your chances of a favorable resolution to your case by speaking with the police.

How quickly can I get out of jail?

After being arrested for a misdemeanor in Houston, you can expect to wait in jail for up to 24 hours before being taken before a magistrate for a probable cause determination. After 24 hours, the police are typically required to release you on a bond of up to $5,000. If you are arrested for a felony, the prosecutor’s office has up to 48 hours to bring you before a magistrate, after which you are normally released on a bond of up to $10,000. Depending on the circumstances of your charges and your criminal record, a magistrate can order you detained pending your trial.
